WAIVER AND INDEMNITY AGREEMENT

(Legally Binding Release of Liability – South African Jurisdiction)

1.⁠ ⁠ASSUMPTION OF RISK

I acknowledge, understand, and voluntarily agree that:
• The Badger Ranch Fun Run (“the Run”) is a voluntary endurance experience that may involve risks including, but not limited to: dehydration, heat exhaustion, hypothermia, falls, injuries, wildlife encounters, emotional distress, physical trauma, and death.
• I accept that participation is entirely at my own risk.
• I am medically, physically, and mentally fit to participate.
• I understand that no amount of safety personnel or medical presence can remove the inherent danger involved in this activity.

2.⁠ ⁠RELEASE FROM LIABILITY

I unconditionally and irrevocably waive, release, and discharge the following parties from all liability, claims, damages, costs, demands, or causes of action, arising from or in connection with my participation:
• Mindset M (Pty) Ltd
• Kyle Evans
• The landowners and affiliates of the farm property
• All volunteers, crew, marshals, or spectators
• Any medics, emergency responders, ambulance services
• Any affiliated companies, directors, employees, agents, or sponsors

This includes all forms of negligence, excluding gross negligence or criminal misconduct.

3.⁠ ⁠INDEMNITY

I indemnify and hold harmless the above-mentioned parties against any and all claims, liabilities, damages, costs, or legal fees arising from:
• Personal injury or death
• Property loss or damage
• Medical or emergency incidents
• Rescue or evacuation expenses
• Changes to format, delay, or route

4.⁠ ⁠MEDICAL & EVACUATION POLICY
• On-site medics are available for basic care and emergency triage.
• Any ambulance, evacuation, or hospitalisation will be at my own expense.
• I authorise medical care to be arranged on my behalf if required.
• I accept full responsibility for managing my own medical conditions.

5.⁠ ⁠REFUND & POSTPONEMENT POLICY
• No refunds will be issued for injury, withdrawal, disqualification, or non-completion.
• If the event is postponed, it will be rescheduled.
• If I am unable to attend the new date, I will be eligible for a 60% refund, provided I notify organisers within 7 days of the announcement.
• No other claims, transfers, or compensation will be considered.

6.⁠ ⁠NOT AN OFFICIAL RACE

I understand and accept that:
• This is not a sanctioned sporting event.
• There are no rankings, prizes, or official results.
• Event rules may be revealed only at the start line.
• I am responsible for following all directions and safety protocols.

7.⁠ ⁠SEVERABILITY

If any part of this agreement is found unenforceable, the rest shall remain valid and enforceable under South African law.

8.⁠ ⁠JURISDICTION

This waiver is governed by the laws of the Republic of South Africa.
Any legal proceedings shall be handled by the Western Cape High Court or relevant local jurisdiction.

9.⁠ ⁠ACKNOWLEDGEMENT

By clicking “I Accept,” I confirm that:
• I have read and understood this entire waiver.
• I accept full responsibility for my participation.
• I release all associated parties from liability.
• I waive any legal rights to claim damages, except in cases of gross negligence or criminal conduct.
