12 Hours of Darkness

1.⁠ ⁠Acceptance of Terms
By registering for the 12 Hours of Darkness event, you agree to these Terms and Conditions in full. This agreement becomes binding upon payment and/or submission of the registration form.

2.⁠ ⁠Event Overview
• Main Event: A 12-hour endurance challenge held overnight from 7 PM Friday, 1 August to 7 AM Saturday, 2 August 2025.
• Weekend Duration: 1 – 3 August 2025 (full weekend experience)
• Venue: Gecko Rock Private Nature Reserve, Nougaspoort Valley, Klein Karoo, 30 km from Touws River
• Organizer: Mindset M (Pty) Ltd

3.⁠ ⁠Participation Requirements
• Participants must be 18 years or older. No minors allowed without prior written consent from a parent or legal guardian.
• All participants are required to complete a waiver/indemnity form and provide any relevant medical declarations.
• The organizer reserves the right to refuse entry or remove a participant for any behaviour deemed unsafe, disrespectful, or non-compliant with event rules.

4.⁠ ⁠Indemnity & Risk Acknowledgement
This is a physically demanding endurance event held in remote natural terrain. By entering, you confirm the following:
• You enter at your own risk.
• You voluntarily accept full responsibility for any injury, illness, loss, or damage sustained during or as a result of the event.
• You release Mindset M (Pty) Ltd, Gecko Rock, and all affiliates, staff, contractors, and sponsors from any claims of liability, except in cases of proven gross negligence.
• You consent to emergency medical care if deemed necessary by officials, and understand that all costs are your responsibility.

These terms align with South African Consumer Protection regulations and standard event practices.

5.⁠ ⁠Cancellation & Refund Policy
Cancellations by Participants:
Because of the high level of planning and limited capacity, the following refund structure applies:
• More than 60 days before event (before 1 June 2025): 85% refund
• 45–59 days before event (1 – 15 June 2025): 75% refund
• 30–44 days before event (16 – 30 June 2025): 50% refund
• Less than 14 days before event (after 18 July 2025): No refund

Additional Notes:
• No refunds will be granted for late arrivals or no-shows.
• Entries are non-transferable without written consent from Mindset M (Pty) Ltd.

Cancellations by the Organizer:
• If the event is cancelled, a full refund will be issued.
• If the event is postponed, your entry will be carried forward to the new date. If you are unable to attend the new date, you may request a refund within 7 days of the announcement.

6.⁠ ⁠Code of Conduct
All participants agree to:
• Treat staff, volunteers, and fellow athletes with respect.
• Follow all instructions from the event team and safety crew.
• Avoid any form of harassment, substance use, or disruptive behaviour.

Failure to comply will result in removal from the event with no refund.

7.⁠ ⁠Media Consent
By attending the event, you grant Mindset M (Pty) Ltd the right to photograph, film, or record you during the event. These materials may be used for marketing, editorial, or promotional purposes across platforms. No compensation will be provided.

8.⁠ ⁠Personal Data & POPIA Compliance
All personal information is collected in line with the Protection of Personal Information Act (POPIA). Your data will be stored securely and never sold or shared without consent, except where required by law.

9.⁠ ⁠Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be handled under South African jurisdiction.
